The hole in the immunity clause

A policeman who tried unsuccessfully to use the immunity clause of the Constitution to evade conviction on charges of abuse of office has uncovered an important hole in the immunity clause. The judge ruled that the people listed for immunity under Bainimarama’s constitution are not immune from prosecution for certain offences under the Crimes Decree. These include corruption, abuse of office, forgery and sexual offences. What this means is that Bainimarama and Khaiyum could also be convicted for such offences. They may think their tracks are well and truly covered for these offences but that’s what every criminal thinks.
